When you file for Chapter 7 bankruptcy, all lenders and creditors are placed on an automatic stay. No one can legally seize your vehicle or pursue a deficiency judgment unless they receive permission from the court. If your car has already been repossessed by creditors, you must act quickly. You have a very small window of time to work within. Creditors are required to provide notice deficiency and sale before they can sell your property. Bankruptcy must be filed within this short 10-day notice window in order to stop the repossession.
