In Illinois, child custody matters are divided into two general categories:
- Parental responsibility: Commonly known as legal custody, the allocation of parental responsibility involves major decisions regarding the child’s life, including education, health care and religion.
- Parenting time: Also known as visitation, parenting time concerns where the child actually lives and spends his or her time. The law favors shared parenting time so that both parents can maintain a meaningful role in the child’s life, absent issues such as abuse or neglect.
Resolving Custody Disputes
In handling custody disputes, I work closely with my clients to help them find common ground with the other parent. While contentious disputes are common, they can often be resolved by communication and focusing on the common goal of protecting the child’s best interests.
